Chief Justice and head of the Supreme Court Visits Kunduz, Badakhshan, Balkh, Jawzjan and Baghlan Provinces

H.E. Sheikh Abdul Hakim Haqqani, Chief Justice and head of the Supreme Court, accompanied by Mawlawi Mohammad Juma “Fayzani”, Director of Planning and Policy of the Supreme Court, Hafiz Mawlawi Abdul Wali “Mahmood”, Deputy Director of the General Directorate of Judicial Inspection, and Mawlawi Faqir Mohammad “Munib”, Judicial Member of the said Directorate, commenced an official visit on the 16th of Zul-Qadah 1447 AH to the provinces of Kunduz, Badakhshan, Balkh, Jawzjan, and Baghlan.
The purpose of the visit was to supervise and further improve court affairs, strengthen cooperation and coordination between the courts and other Emirate institutions, listen to the concerns of citizens, and identify and address the needs of provincial courts.
During the visit, the Honorable Chief Justice and head of the Supreme Court met with judicial, administrative, and military officials and personnel of the courts in each province, reviewed the courts’ previous activities, listened to their needs, and held detailed discussions with them regarding the provision of better services to the people.
In addition, H.E. Sheikh Sahib also met with officials and personnel of the security, justice, administrative, and other institutions in each province and instructed them to strengthen coordination among Emirate institutions and provide necessary cooperation with one another in accordance with established principles whenever required.
H.E. Sheikh Abdul Hakim Haqqani provided the officials and personnel of the courts and provincial Emirate institutions with necessary guidance and instructions regarding improvement of affairs, better handling of challenges, and other related matters. He emphasized the importance of unity, solidarity, and strengthening the Islamic system, stating that, Alhamdulillah, the Islamic system is now prevailing throughout the country without interference from any foreign power.
The Honorable Sheikh Sahib instructed officials to maintain kind, proper, and Islamic conduct toward the people so that citizens may live in an atmosphere of security, peace, and confidence. He emphasized that all officials must pay serious attention to their duties and responsibilities and that no individual is permitted to punish any offender arbitrarily. He further instructed that prisoners and offenders should be treated properly so that, upon release, they may contribute positively to society and the Islamic system.
The Honorable Chief Justice and head of the supreme court further stated that offenders should, after proper treatment, be handed over to the relevant authorities so that punishments may be determined in accordance with Islamic Sharia. He stressed that any form of cruelty, mistreatment, or abuse against prisoners and offenders is unacceptable and must be strictly avoided. He also advised officials to safeguard public property with honesty and responsibility in order to attain the pleasure of Allah Almighty and ensure timely service delivery to the people.
Furthermore, H.E. Sheikh Sahib stated to court officials that all officials are under examination, but judges bear a greater responsibility and trial. He noted that the establishment of the Islamic system in Afghanistan is a great blessing from Allah Almighty, for which gratitude must be shown through proper implementation of Sharia. He added that ethnic, regional, and linguistic discrimination has now ended across Afghanistan and emphasized that implementation of the Sharia system is carried out through the courts, as all case files and evidence are ultimately referred to judges.
Additionally, the Honorable Chief Justice and head of the Supreme Court issued the following specific directives to court officials:
1. Responsibility is like the bridge of Sirat over Hellfire; if a responsible person deviates in fulfilling his duty, it will become difficult for him on the Day of Judgment like the bridge of Sirat.
2. No judgment should be issued unless full investigation has been conducted and certainty has been achieved regarding the matter.
3. Good conduct should be maintained with clients, and both plaintiffs and defendants should be properly informed and satisfied regarding judicial decisions and their legal rights.
4. Appellate courts must maintain full supervision over primary courts, strengthen coordination among judicial members, and address court-related issues promptly.
5.Any deficiencies found in judicial decisions should be clearly identified and properly substantiated before being referred back to primary courts.
6. Appellate courts should review decisions of primary courts with the intention of confirmation unless legal deficiencies are identified.
7. The people of Afghanistan have the right upon officials to be served properly, to have the rights of the oppressed restored, and to prevent oppression.
8. Officials must obey their superiors in matters consistent with Sharia, as obedience is a major means for the preservation and continuity of the Islamic system.
9. cruelty and injustice must be avoided, because Allah Almighty does not grant permanence to a system founded upon oppression.
10. Great caution must be exercised regarding public treasury matters, as accountability before Allah Almighty is inevitable.
11. Every subordinate official must obey his superior official.
12. Conduct and morals should be maintained in such a manner that even non-Muslims are positively influenced by Islamic ethics.
13. Officials should avoid situations that may give rise to suspicion or accusations, whether in meetings, gatherings, hospitality events, or other circumstances.
The ten-day visit of the Honorable Chief Justice and head of the Supreme Court concluded on the 25th of Zul-Qadah 1447 AH.
